GENERAL TERMS AND CONDITIONS and rules for using the services provided and accessible through the Unknown Sofia mobile application
This document contains the General Terms and Conditions of the contract for the use of the Unknown Sofia (General Terms and Conditions) provided via the mobile application and regulates the relations between CEED BG and each of the end users (individuals) of the services available through Unknown Sofia.
Before using the Unknown Sofia mobile application as a User, please read these Terms of Use carefully.
• General Information
CEED BG with registered office and address of management in the Republic of Bulgaria, Sofia, 24 Anton Chekhov Str., Registered in the Commercial Register of the Republic of Bulgaria under UIC 205608609, e-mail: capitaladvertisingbg@gmail.com is a developer company, administering, updating and supporting the Unknown Sofia mobile application.
Unknown Sofia is a mobile application that provides an opportunity for individuals to place and check assessments of the degree of compliance with anti-epidemic measures in tourist sites such as hotels, restaurants, bars, hostels, guest houses and more.
Each person who uses the services provided by the mobile application creates profiles and is a "User" and a party bound by these General Terms.
These General Terms and Conditions represent an AGREEMENT between the User and CEED BG, by which the User receives the right to use the services of the mobile application Unknown Sofia for personal and non-commercial purposes in compliance with the terms specified here.
By accessing (loading) the Unknown Sofia mobile application and registering, you as a User CONFIRM that you agree to be bound by these general terms and conditions and any subsequent changes thereto, and agree to abide by them in accordance with current legislation. In case you do not agree with any of THEM, do not register to access the Unknown Sofia application.
2. Access to the mobile application
The mobile application is designed for mobile devices using Android and iOS operating systems and is available for free download in the online stores GooglePlay and Apple Store.
3. Use of the Unknown Sofia mobile application
This application allows the User to place and check ratings of tourist sites. To use the services of Unknown Sofia, the user must make a short registration. To use the "Rate a tourist site" feature, the registered user must allow Unknown Sofia to use the location of the device.
Using the function, the user agrees "Rate a tourist site" the user agrees that the rating, comment and usernames become visible to users of the application "Unknown Sofia". 4. Registration and profile
In order to be able to use the services offered through Unknown Sofia, the User must first register in the mobile application. The user can access the services of the Unknown Sofia application through a new registration via email, two names and a password.
Each User is responsible for unauthorized access to his account. Passwords and other information for access and use of services in the mobile application must not be provided to third parties.
By registering a new user or the User provides his consent to the processing of his personal data. Personal data will be processed in compliance with the requirements of current European and Bulgarian legislation.
The User has the right to terminate the contract under these Terms and Conditions at any time by deleting the Mobile Application of CEED BG from his device, thus terminating the use of Unknown Sofia and the services provided.
6. Copyright
The software providing the operation of the Unknown Sofia mobile application, including design, code, databases, text, drawings, graphics, sketches and any other information or elements, is subject to copyright within the meaning of the Copyright and Related Rights Act and are owned by CEED BG. No part of the objects of protection may be reproduced, translated, modified or used in any way without the prior written consent of CEED BG.
Any unauthorized use, reproduction, distribution, modification, etc. part or all of the content of the Unknown Sofia mobile application is prohibited, constitutes an infringement and will be prosecuted in accordance with the law.
7. Limitation, release from liability
All content of the mobile application is provided "as is" without any warranties of any kind or nature, express or implied, disclaims and excludes all other warranties including, but not limited to: availability, accuracy, reliability , timeliness, completeness, implied warranties, fitness for a particular purpose, non-infringement of intellectual property rights current property or other related rights. Apart from the above, the administrator of the mobile application does not guarantee and does not make any statements about the accuracy, probable results or reliability of the use of services for other purposes on the Internet, the availability of a mobile network, the upload of materials to sites not related to the mobile application .
BY ACCEPTING THESE GENERAL TERMS AND CONDITIONS, THE USER AGREES THAT HE RISKS THE RISK OF USE OF THE SERVICES, AS BASIC, AS WELL AS ACCOMPANYING.
The mobile application works only as long as there is a network of the used mobile device and GPS is turned on. If the User is offline, the application will not work. If the user does not authorize the use of the location of the device, he will not be able to use the function "Rate tourist site".
CEED BG is not responsible for the consequences, incl. any damages caused by or in any way related to the access, use or inability to use this mobile application and the services offered through it.
CEED BG is not responsible for any delay or non-performance beyond the control of CEED BG.
8. Mode of information about personal data and content uploaded in the application
When using the mobile application, the User agrees to CEED BG to process the provided personal data.
CEED BG, as the administrator of the mobile application Unknown Sofia, is committed to ensuring the inviolability of the information containing personal data provided by Users through completed registration applications. Disclosure is possible only in cases where the information is required by state bodies or officials authorized by law to request and collect information containing personal data and in compliance with the statutory procedure.
CEED BG does not store the location data of the user's device, which is required for the use of the "Rate a tourist site" function.
CEED BG can provide collected statistical information to compile internal statistics, as well as for the purposes of direct marketing (its own and its partners). By accepting these General Terms and Conditions, the User agrees to the processing of personal data provided by him when filling out the application for registration for the purposes of direct marketing. The user has the right to object to the processing of his personal data for the purposes of direct marketing by sending a written message to CEED BG to the following e-mail for contacts: capitaladvertisingbg@gmail.com
The sending of information about changes in the conditions of registration, the general conditions of use or the conditions for providing the services by the providers is not considered as direct marketing.
9. Links
CEED BG is not obliged to fully review the content of all sites to which there are links from the mobile application, and therefore is not responsible for the content of any linked site, as well as links from portals. The inclusion of a link in the content of the Unknown Sofia mobile application does not mean a commitment by CEED BG. The use of such a linked website is at the own risk and responsibility of the User.
10. Terms of use and modifications
CEED BG may at its discretion revise and amend any of the provisions of these General Terms and Conditions, as well as change, cancel or terminate services, database or content of the mobile application at any time by notifying Users via Unknown Sofia, or via email. CEED BG may also, in its sole discretion, impose restrictions on certain services or features or restrict Users' access to all services without notice and without liability.
Users who do not agree with the changes in the General Terms and Conditions have the right to delete their Account and terminate the use of the services, as well as explicitly request the deletion of the account and the data provided by them.
11. Other provisions
Any claim related to the use of the mobile application is settled in accordance with the provisions of current Bulgarian legislation. The invalidity of one or more provisions of these Terms will not affect the effect of the other provisions.
